(LAW - WEST INDIES) Anthony Stokes (1736-1799)
[Docket caption:] Mr. Stokes's Opinion on Behalf of Mr. Fling [and, docket caption:] Anthony Stokes, Esq. Account Agst John Fling, Mariner.[Antigua, May 24th, 1765 and October 16th, 1765.] Two manuscript documents signed; each accomplished on large, single folio sheets, partially untrimmed, measuring approx. 15¾ by 10 inches, [2] pp., combined. Formerly folded; boldly engrossed and autographed; fine condition.
West Indies law on the island of Antigua by a future Georgia jurist , Anthony Stokes (1736-1799) was born in Wales, educated at Inner Temple, and practiced law in Antigua until 1765. Stokes then removed to St. Kitts, and thence removed to Georgia where he was chief justice. In 1776 the patriots forced his removal, but he returned to serve as chief justice from 1779-1782. In the first document, Stokes’s legal expenses in connection with John Fling, mariner are clearly spelled out: “My fee on an Action of Trover [wrongful taking of personal property] for several Negroes”; fees for filing the Declaration; fees for an Action of Ejectment for Lands in Premises in Saint Johns, for Continuances, Issues, Trials, oaths, etc. Very interesting is the last fee pertaining to the Stamp Act: “Two half Crown Stamps, and two large Sheets of Paper.” The second document summarizes Stokes’ legal opinion in which his client, in the Court of Common Pleas in Antigua, was successful in his suit to assertion legal authority for his property on St. Johns mentioned above. Stokes declares that Fling has an unencumbered title of his property and can sell such at public sale.
